Compliance Workshop
This workshop will be a two-part session and free to FMHRA members. The compliance topics that will be reviewed are associated with the prescreening and on-boarding of new employees; specifically in the areas of background checks and unauthorized employment.
Presenter: Jim Larson, CPA and FMHRA Treasurer
Part one will be a presentation on the need to implement background checks. It will review how to develop, implement and maintain the process, as well as how to make the background check process work for the goals of the organization. Specific types of checks, such as criminal, credit, driving, certification/education and sex offense checks will be reviewed in detail. The presentation will look at how to apply the screening process to new hires, existing staff and volunteer positions. The use of release forms, eligibility disqualifiers and other legal components will be discussed. It will also address ways to modify a background check policy and customize it to fit the needs of an organization.
Presenter: ICE Agent Robert KylePart two of the workshop will look at ways employers can be a workforce compliance partner with the U.S. Immigration and Customs Enforcement (ICE) to minimize unauthorized employment. The presence of undocumented workers in the U.S. who have secured jobs by fraudulent means, including presentation of false documents, completion of fraudulent benefit applications and thefts of identities has led ICE to develop the ICE Mutual Agreement between Government and Employers (IMAGE) program. This program will detail best hiring practices, fraudulent document detection of I-9's, how to use E-Verify, anti-discrimination procedures, pitfalls for employers to avoid and working with government agencies. Pending legislation and changes coming will also be highlighted.
