Program Summary: 

The NLRB and U.S. DOL have increasingly focused on the joint employer doctrine. Companies that engage subcontractors, consultants, and/or temporary workers through staffing agencies are well advised to conduct risk management to avoid being held liable under the joint employer doctrine.

Learning Objectives:

1. Audience will recognize risks of creative non-employment worker arrangements.
2. Audience will understand horizontal and vertical joint employee analysis.
3. Audience will recognize some contractual protections to consider.
4. Audience will understand the "control" issue under current law.

About the Speaker: 

Kristy L. Albrecht is a shareholder in Fargo, ND and a member of the Employment & Labor, Litigation, Transportation, and Appellate Groups. She advises employers on a variety of employment law issues, including hiring, firing, discipline, employee leave laws, employee handbooks, drug and alcohol policies, and separation agreements.

Additionally, Kristy advises and defends motor carriers on DOT issues, particularly focusing on compliance and audit work under the regulations of the Federal Motor Carrier Safety Administration. An experienced litigator, she represents clients before state and federal agencies and in state and federal court on various types of claims, such as workers' compensation (WSI), unemployment insurance, discrimination, harassment, retaliation, wrongful termination, and trade secrets violations.
